Terms of service

These Terms of Service ("Terms") govern the relationship between the provider of the NISMap service and its users. By entering into the contract, the user confirms acceptance of these Terms.
1. Parties
The provider is Inger s.r.o., ID 50178831, registered in the Slovak Republic (full details are available in the Imprint). The user is any natural or legal person using the NISMap platform at nismap.com.
2. Subject of the service
NISMap is a SaaS platform for self-assessment and management of cyber compliance under the NIS2 Directive, GDPR, DORA and related regulations. The service includes automated technical scans, compliance questionnaires, AI-assisted report drafting and auditor integration.
NISMap outputs are advisory and intended to help the user prepare for compliance. They do not replace the binding opinion of the competent authority (NBÚ/NÚKIB), legal advice or an auditor's service.
3. Contract formation and registration
The contract is formed by account registration and acceptance of these Terms and the Privacy Policy. Registration is free; paid plans activate after successful payment via Stripe.
4. Pricing and payment
Current prices are listed at /pricing. Payments are processed by Stripe Payments Europe. Invoices are issued electronically in accordance with applicable VAT legislation.
5. Duration, renewal and termination
Monthly plans renew automatically until cancelled by the user. Annual plans renew every 12 months. After cancellation the service remains active until the end of the paid period.
6. Right of withdrawal (consumers)
EU consumers have a 14-day right of withdrawal from the contract under Directive 2011/83/EU and applicable national law (SK Act 108/2024 Coll. § 20(1), CZ Act 89/2012 Coll. § 1829). If the consumer expressly agrees to start the service or digital content before the withdrawal period expires and was informed of losing the right, the right lapses (SK Act 108/2024 Coll. § 19(1)(a) and (m)). The right of withdrawal does not apply to business-to-business contracts.
7. Liability and limitations
- The service is provided "as is" with reasonable care.
- The provider is not liable for indirect, consequential or lost profits.
- Aggregate liability is limited to the fees paid by the user in the preceding 12 months.
- Liability for wilful acts or gross negligence is not limited to the extent prohibited by law.
Consumer carve-out
If you act as a consumer under the applicable national law (Slovak Act 108/2024 Coll. on consumer protection for SK consumers; Czech Act 89/2012 Sb. (Civil Code) §§ 1810-1840 together with Act 634/1992 Sb. for CZ consumers), the limitations of liability above apply only to the extent permitted by law. Your statutory consumer rights are not affected — in particular, we cannot exclude or limit liability for damage to life or health caused by defective service, nor for wilful misconduct or gross negligence. This clause also reflects Council Directive 93/13/EEC on unfair terms in consumer contracts.
8. Availability and SLA
The service targets 99.5% monthly availability (excluding scheduled maintenance). Maintenance windows are announced in advance on /status. Downtime is handled per the relevant plan terms.
9. Complaints
Complaints can be submitted by e-mail to support@nismap.com. The provider will respond within 30 days in accordance with applicable consumer protection law.
10. Data protection
The processing of personal data is governed by the separate Privacy Policy at /privacy. The list of sub-processors is published at /sub-processors.
11. Governing law and dispute resolution
These Terms are governed by Slovak law. Disputes are resolved before the competent courts in the Slovak Republic. Consumers may use alternative dispute resolution — in Slovakia the Slovak Trade Inspection (SOI, www.soi.sk), in the Czech Republic the Czech Trade Inspection (ČOI, www.coi.cz), or the EU ODR platform.
12. Changes to these terms
The provider may update these Terms. Material changes will be notified to registered users by e-mail at least 14 days before they take effect. The user may terminate the contract with immediate effect if they disagree with the changes.

14. Supply-chain & NIS2 transparency
Inger s.r.o. falls below the thresholds of Slovak Act 366/2024 Z. z. (which transposes Directive (EU) 2022/2555 — NIS2) as a micro/small enterprise within the meaning of Art. 2(1) NIS2 and Commission Recommendation 2003/361/EC. As a result, Inger s.r.o. is not itself a directly regulated entity under NIS2.
We nonetheless provide the following transparency information for customers who are within scope of NIS2 and who, under Article 21(2)(d) of Directive (EU) 2022/2555, must assess the security of their supply chain, including their direct software service providers.
