- SK: Act 69/2018 Coll. § 31 — up to €10,000,000 or 2% of turnover only for operators of a critical essential service (para. 3); other operators of essential services up to €7,000,000 or 1.4% (para. 2); selected duties €300 to €500,000 (para. 1)
- CZ: Act 264/2025 Coll. § 59(4) — higher-obligations regime up to CZK 250,000,000 or 2% of turnover, lower-obligations regime up to CZK 175,000,000 or 1.4%
Under NIS2 Art. 20 the management body approves the measures, oversees their implementation and can be held liable under national law (in SK, § 20(4)(h) of Act 69/2018 designates the persons responsible for approving measures and oversight; in CZ, § 14 of Act 264/2025 Coll. sets requirements for senior management). Fines under these acts are imposed on the entity, not on individuals. Where corrective measures are not met, the regulator can temporarily ban a person from office — in SK for operators of a critical essential service (§ 29j(4) of Act 69/2018), in CZ for providers in the higher-obligations regime (§ 58 of Act 264/2025 Coll.).

How the fine is calculated
NIS2 sets two limits — a fixed amount and a percentage of annual turnover, the higher value applies. Legal basis: EU NIS2 Directive 2022/2555 Art. 34 (administrative fines); SK Act 69/2018 Coll. § 31 (administrative offences); CZ Act 264/2025 Coll. § 59(4) (offences of regulated service providers). Slovak and Czech caps differ from NIS2 — see legal basis below.
- Essential entity: €10,000,000 or 2% of total annual turnover (whichever is higher).
- Important entity: €7,000,000 or 1.4% of total annual turnover (whichever is higher).
These are the maximum fines. Actual amounts depend on severity, duration, cooperation with the regulator and other factors.
